Hi I am new to this forum but wanted some advice and hoping someone can help
I made a money transfer of £3,000 pounds in January to my then boyfriend (who I had a orfi paper with) I did not sign anything nor do I have any copies of this paper but I did see it when I was in egypt I am not sure if its a ligit one, anyway I finished the relationship with him two months ago (no nothing to do with him hiding a wife or asking for a visa, I just didnt want a relationship with him)but he agreed he would pay me back the money that he took I was with him for almost 2 years
I just wanted to know as I have his bank details and my bank has confirmed the transaction was made and they wrote to me telling me when it went to his account if he does not pay me back like he said he will is there another way I can get my money back? I have papers from the bank which has his details and proof...

Not sure, but am afraid not. You transfered money by your own free will, the bank can only transfer money when the owner of the bankaccount orders to transfer...you did and he didn't so that's an expensive lesson...sorry!

An Urfi, papers or not, is not an official marriage in the eyes of Egyptian Law... so that would be deemed irrelevant info PC.

Do you have a written agreement, it doesn't have to be legal or fancy but some indication this was not a gift? An email perhaps?

The document doesn't have to be signed, just evidenced that the recipient at least indicated he was aware it was not a gift.

If you have MSN records or his response in an email to you detailing the terms of repayment then you may have a case.

I way definately say so... that is step one. You have all your evidence to support you.

Step two will be trying to find a solicitor who can assist.

details Debt Recovery specialists in various districts throughout Egypt, your next step would be to find one who will a) work internationally and b) one who will not take too much of the recovered debt if successful.

Have you enquired at a CAB back in UK to see if there are Solicitors there who can assist or liaise with an Egyptian Solicitor on your behalf?

Divorces are carried out internationally so I cannot see why with supporting evidence debt recovery should be such a big deal.

I know of someone who lost a hell of alot of money to a guy. She wanted to got to the police because he 'stole' it and she had promises of repayment. Reality was she freely gave him money to start businesses, buy a car, pay off his wife etc etc. I think it will be very difficult for you to get this money back if I'm honest. I wish you the best of luck though.

Worth a try if you can prove it wasn't a gift...

Perhaps a polite email using some big words and legal terms highlighting some quotes from websites detailing that you have a good case to retreive the cash may make him crap himself into paying some back...

I wish you luck, I know for one I would certainly try to get it back.

Failing that threaten to name and shame in his village to his family and friends about the Urfi and the cash... male whore lol... (joke)

Seriously though, there are ways and means to go about things and this is very very common so there are folk out there who can assist.

It is a lot of cash to lose. If you no chance at all at least you tried

Unless you made the correct papers with him at the time you gave him the money to say it was a loan, you have no 'legal' right to reclaim the money. Emails and text messages are not evidence that can be used in court as its not possible to prove the source.

So you are dependant on his honesty to return it or to shame him if he doesn't.

They are sufficient evidence in the UK Penny... you can process an online claim via HMCS and request a fixed amount of money. (I am assuming you made the trasfer from the UK)

Also threats of violence, veiled threats of violece and harrassment via texts and emails can be used to support cases against people.

The biggest obstacle will be when he vanishes...

That is why I advice to stay friendly but scare him a little with some Lawyer talk.

I do think you will have to say goobye to your cash if you are not prepared for a damn hard fight. However, like I said, there are avenues you can look at. I have been down this road with a friend who got cash back when the dude got worried about his reputation.

Personally, I would go to the CAB.

Actually they are not even in 20th! its archaic

I am not sure about Egyptian legal evidence regarding documenting loans... but PC is trying to reclaim this loan from the UK where she is based and it is her cash which she can prove.

If she was in Egypt and did it in cash she may as well pee in the wind.

LF from what she wrote its all verbal and the matter will be subject to Egyptian law/ legal system as she gave it freely..it was not fraudulently taken from her so the bank will not get involved.

She is totally dependant on his goodwill to return the money. As far as the Egyptian law on loans is concerned it would have to be on paper and signed for to have any chance.

but, from a British POV, she can evidence the transfer, receipt his end and has it in writing that he understood it was a loan. Verbal in writing regardless of the method is a contract. This I can 100% state.

My friend kept texts and emails from both sides and put forth a claim and once he got wind of the strength of her proof he paid up.

It was not fraudulatly taken but he cannot claim it was a gift. Not under British Law. She has every right to put claim to what is hers.

She would be fighting her case under British Law. He would be defending under Egyptian... this I cannot foresee the outcome as I have never seen it go so far...

I would be interested to know the outcome though, especially for the many identical cases I am bound to read lol.

My main point is though, realising that she has the backing of the law in regard to the evidence MAY freak him out, especially if he has little or no knowledge of the British Legal System.

If she were in Egypt it would be a different kettle of fish... and how many women do we know who have lost cash to a dude!!! (some cheeky git asked me for cash in Jan lol... after a 2 yr friendship, yeah right!!!)

I cannot see it being cost effective to battle for it, albeit the courts charge very little for small claims in County Courts but this would not qualify I don't think. I only know about what is classified as sufficient evidece to support loan claims.

Which is why I advice CAB as they would be able to a) say if it is possible and b) worth it.

I am only talking through my experience though, I cannot 100% clarify from the Egy side what would happen if a Brit Lawyer were to start the ball rolling.

Perhaps ask another Q about good Lawyers who could offer sound advice, I know three dormant members who would have contacts.

Ah stuff it, we all know this case will be lost through lack of communication, cost, bureaucracy etc...

I am meerly highlighting there is a chance if you wish to attempt to pursue it. You know this guy, would he crack under the pressure of you threatening him with the law?

If not ask someone on here to arrange to have his theiving hands chopped off.

There's probably nothing you can do legally to get your money back,as it was transfered out of your bank with your authority. I hope you did'nt get a loan out in the uk in your name to send the money to him,If that is the case then your responsible for the repayments. [Eek!]

Its hard enough and takes long enough here to get money back even with contracts and papers. It could cost you more trying to get it back and you still wont get it. Put it down to experience and move on.

It will probably cost you as much again to get screwed over by an Egyptian lawyer...

The only thing you can do is contact your bank and tell them you were scammed. Have the bank contact his bank and see if there is anything they can do. Otherwise, on the Egyptian side nothing you can do unless you take him to court. My husband is an Egyptian lawyer and he says you can try to take him to court but it will take FOREVER and cost you a lot of money. Good luck!

I haven't had personal experience of loosing money to a guy from Egypt but I do know from friends and associates that the police and British Embassy will be interested in this. I am not saying that they will get your money back for you but the more info they have on the guys that are obtaining money from foreigners the more that they can do.

Also usually threatening the guy that you will inform his family of the crime usually does the trick, they don't want to bring shame onto the family. Maybe you could also report him to his employer. I guess anything is worth a try if it gets some if not all of your money returned.
